Parents Petition for Reform of Child Bereavement Laws

Two bereaved mothers have started an online petition hoping to motivate change in bereavement compensation laws. 

The tragic accident occurred in November 2014, when a Toyota car carrying five people collided with a Seat travelling in the opposite direction. The driver of the Toyota reportedly lost control whist driving along the A360 in South Yorkshire, and all five passengers were killed.

Fortunately, the driver of the Seat only sustained a broken leg and survived the tragedy. A police investigation ensued, and after questioning a third driver present at the scene, no charges were filed. 

Jordanna Goodwin and Megan Storey, both aged sixteen and from Dorset, died in the crash. Their mothers described the lifelong friends as inseparable.

When their mothers tried to claim bereavement compensation following their loss, they received £12,980 each – a figure described as pitiful by their lawyers, who highlighted the vast sums awarded in libel claims. This sum was awarded as no-one had been found at fault for the crash.

 Since then, the two mothers – Tracey Storey and Vicki McCarthey – have started an online petition campaigning for change to bereavement compensation claims. They hope to see a new system, similar to one in Scotland where judges can settle bereavement claims.

 “This is not about being greedy and seeking more money” Tracey Storey commented whilst speaking to The Times, “as no amount of money can compensate for the loss of Megan or Jordanna. It is about the injustice of the way the system works”.

 The Association of Personal Injury Lawyers (APIL) have expressed their support of the petition. The group have previously campaigned for similar action, claiming not only that the compensation awarded in bereavement claims is too low, but the eligibility criteria are too selective.

  At present, only husbands, wives, civil partners or parents bereaved of children under the age of eighteen are eligible for any bereavement compensation.
